محدوده حاکمیت قانونمند مبتنی بر جبران آثار اعمال حق حاکمیت بر منابع طبیعی

ملخص المقالة :
حاکمیت برمنابع طبیعی، به عنوان یکی از اصول مسلم حقوق بین الملل عمومی، به طور مکرر از دهه پنجاه میلادی در قطعنامه های مجمع عمومی ملل متحد و سایر ارگانهای ملل متحد خصوصاً پاراگراف اول ماده 2 منشور حقوق و تکالیف اقتصادی کشورها تصریح و مورد توجه ویژه قرار گرفته است. اصل مزبور دقیقاً با عنوان: حق حاکمیت دائمی کشورها بر کلیه منابع ثروت زیرزمینی و فعالیت های اقتصادی ذکر شده و بیانگر موضوع حاکمیت کشورها بر منابع طبیعی خود می باشد، به طوری که اصل مزبور تاثیر مستقیمی در اتخاذ تصمیم و اعمال تدابیر اقتصادی در دولت ها و در ارتباط با سایر دولت ها را خواهد داشت همچنین در استیفای حقوق فوق الذکر، هیچ دولتی بر او اولویت نخواهد داشت. مجمع عمومی ملل متحد با تصویب قطعنامه 1803 در سال 1962 حق حاکمیت دائمی دولت ها بر منابع طبیعی شان را به رسمیت شناخت؛ که اعمال این حق را منوط به جبران خسارت دانست و در این خصوص نیز راه حل میانه ای اتخاذ نمود که تقریباً به نظرات دولت های سرمایه فرست نزدیک بود؛ قطعنامه مزبور معیار غرامت مناسب را بعنوان معیار غالب حقوق بین الملل تعیین می نماید. با این وصف، سیر تحول مفهوم حاکمیت بر منابع طبیعی و اعمال این حق توسط دولت ها در اوایل قرن بیستم به عنوان امری غیر مشروع تلقی می شد اما در نهایت با لحاظ برخی محدویت ها به عنوان عملی مشروع قلمداد شد.
