تدابیر تنبیهی نظام حقوقی ایران در موضوع پسماندها (مطالعه تطبیقی با حقوق فرانسه)

ملخص المقالة :
امروزه مدیریت پسماند یکی از ضروری ترین محورهای توسعه پایدار محسوب می شود. روند رو به گسترش تولید پسماندها، ضرورت توجه به این موضوع را دو چندان نموده است. پژوهش حاضر بر اساس روش توصیفی تحلیلی و با اتکاء به منابع کتابخانه ای اعم از کتب و پژوهش های انجام گرفته مرتبط ، صورت پذیرفته است. در کشور ما، اصل 50 قانون اساسی و قانون مدیریت پسماند به صورت تخصصی و همچنین قوانین پراکنده دیگر از جمله قانون مجازات اسلامی، ظرفیت های قانونی مناسبی در مدیریت پسماند مقرر نموده است. از جمله سازوکارهای پیش بینی شده، ضمانت اجراهای کیفری برای مرتکبین اعمال خارج از چارچوب و ضوابط قانونی در حوزه پسماندها می باشد. بر خلاف برخی از کشورها که از دو ابزار حبس و جزای نقدی برای کنترل این موضوع بهره گرفته اند، سیاست تنبیهی نظام حقوقی ایران، مبتنی بر جریمه متخلف بوده و اشاره ای به حبس به عنوان مکانیزم بازدارنده ننموده است.
