اصلاح سیاست‌گذاری ارضیِ ایران و رفع موانع اجتماعی آن برطبق نظریۀ منطقۀ الفراغ

ملخص المقالة :
خردی و پراکندگی زمین‌های کشاورزی مانع استفادۀ بهینه از منابع آب‌وخاک شده، امنیت غذایی کشورمان را به مخاطره می‌اندازد. اعتقادات مذهبی قاطبه ملت اقتضا می‌کند که ایجاد تغییرات ساختاری در فرایند توسعه اقتصادی بر مبنای باورهای دینی آنان باشد. ازاین‌رو، مقالۀ حاضر ضرورت یکپارچه‌سازی و رفع موانع اجتماعی آن را در چارچوب نظریۀ شهید صدر تبیین نموده که فقیهی مسلط بر مسائل نظام سیاسی و حکومتی بود. موضوع با روش تحلیل اسنادی تجزیه‌وتحلیل شده، یافته‌های تحقیق نشان می‌دهند: برخی از مالکین اراضی خُرد به استناد قانون مالکیت خصوصی و احکام ارث مانع اجرای یکپارچه‌سازی می‌شوند. پدیدۀ اجتماعیِ ناشی از کنش اجتماعی آنها مانع اجرای طرح در سطح جامعه می‌شود. برطبق نظریۀ شهید صدر، حکومت می‌تواند بنا بر مصلحت جامعۀ مسلمین مفسدۀ سیاست‌گذاری‌های قبلی را در ظرف وجودی منطقۀ الفراغ منتفی سازد. مالکیت خصوصی افراد بر اراضی خُرد را به استناد قاعدۀ لاضرر سلب کند و قانون ارث را ضمن ایجاد تغییر در نحوۀ اجرای آن مهار نماید.
