Abstract :
Vulnerable groups, including children, need special support in their particular circumstances through the adoption of differential policies. A differential policy in domestic law is presented as a specific crime in the field of children or in the form of intensified punishment. The procedure for the hearing of children and adolescents has a number of differentiated features in adulthood. Including the fact that police and judges exclusively or frequently involved in pediatric trials should be familiar with the creation of courses with a variety of sciences such as child psychology, social work and criminology. The hearing should be completely censored and protected by the child. It seems that the special procedure for the criminalization of children in customary law is inconsistent with Islamic law, and there are no indications and prohibitions on the application of this proceeding in valid jurisprudential texts.
