Abstract :
Field and Aims: Israel started its new wave of aggression in the Gaza Strip on 7 October 2023, and committed unprecedented crimes, as a result of which thousands of Gaza residents were martyred or injured. Despite this, Israel and its Western supporters talk about the "Right to Self-defense" and justify the aggression with this same phrase. This is despite the fact that according to international regulations, people under colonial rule and foreign occupation, if they are not able to exercise their right to self-determination peacefully, they have the right to resist with all available means -even armed struggle.
Method: This research was conducted using a descriptive-analytical method and using library and documentary resources.
Finding and Conclusion: In the light of the right to self-determination as one of the governing rules of international law, The people of the occupied land -including Palestine- can claim the right to resistance with all available means and in compliance with the standards of international law. The third governments are also obliged not only to refrain from recognizing the illegal situation caused by the occupation, But in order to end the violation of the mandate and occupation rules, They should not hesitate to provide their spiritual and material assistance to the people under domination. Also, the occupying power does not have the right to resort to legitimate defense in the occupied land, And it can be said that the right to resistance provides a guarantee for ending the occupation.
