Abstract :
Introduction: Marriage in Imami jurisprudence and Iranian law is divided into two types: permanent and temporary. The principle of marriage in Islam is permanent marriage, and temporary marriage is placed according to emergency conditions and as a temporary and secondary solution; However, the lack of clear laws regarding the temporary marriage license in Iranian law has caused some men to abuse it without considering the emergency conditions and cause a lot of damage to the society and family. The aim of the present study is to investigate the effects of non-compliance with the conditions of temporary marriage license by married men and its damages on marital relations between permanent spouses and the reflection of these damages on family life.
Methods: Data collection was done through semi-structured interviews with women whose husbands agreed to do this. Purposive sampling method and theoretical saturation criteria were used.
Findings: The results of the research indicate that the temporary marriage of married men leads to the creation of mental and emotional tensions between family members and the degradation of their dignity and social status, and brings many risks to marital relations and ultimately causes them to be excluded from family and family gatherings; Because the public opinion of the society does not accept temporary marriage by married men and sometimes looks at them as a lustful person. The effects of this in marital relationships are damage to emotional relationships, disruption of trust between spouses, disruption of family security, damage to physical relationships, disruption in family management and in family relationships having negative effects on relationships between family members, communication with acquaintances and views The people around the family and its damage to the women of such men can be divided into four categories: psychological damage, physical damage, economic damage and social damage; Using this institution without a framework and not explaining the conditions of its permissibility from the point of view of Sharia and law by married men can cause irreparable psychological damage to the wives and become a factor of threat and collapse of the family.
