Abstract :
The purpose of the present study was to examine protective and educational measures in relation to children in Iranian and French law, emphasizing the role of education in it. Protective and educational measures are a series of social defense tools that are used by law and by a judge and as a result of a crime, in accordance with the child's situation, until the child recovers and adapts to society and does not commit crimes. These measures have the power of obligation and coercion and are implemented in the case of dangerous individuals to prevent the possible commission of crimes to maintain public order in society. The results indicate that the principles of protective and educational measures in relation to children in Iranian law are relatively consistent with French law. Protective and educational measures for children in Iranian and French law are considered a basic need along with other punishments. Adopting protective and educational measures for children has been established in Iranian and French law. Protective and educational measures with the approach of reforming and educating children aim to prevent recidivism and prevent the increase in insecurity and disorder in society. Providing valuable social and jurisprudential responses such as preventing adolescents or children from associating with inappropriate people and guidance to cut off contact with the aforementioned individuals, as well as introducing them to specialists who guide children and adolescents, handing over the child to parents for education, etc. are very worthy measures of the Islamic Penal Code approved in 2013.
