The principle of strict liability of athletes in the use of energy-enhancing drugs; Concept, effects and justified causes

Abstract :
Today, the use of energy-enhancing drugs (doping) by athletes is considered one of the most important international challenges in the field of sports law. International organizations, including the World Anti-Doping Organization, have taken important measures to combat doping. The most important of these measures is the formulation of the global anti-doping code. According to this principle, which has a wide scope, it is the Athletes’ personal duty to ensure that no Prohibited Substance enters their bodies. Athletes are responsible for any Prohibited Substance to be present in their Samples. so whether the athlete intentionally or unintentionally uses a prohibited substance or is negligent or in any other way is responsible. Although the principle is the strict liability of the athletes, some justified reasons have been accepted in this regard; For example if mistakes made during the transport of the sample or during the analysis of the, the responsibility is excluded.
