Abstract :
In oil-rich countries like Iran, for the development of oil and gas fields through investment in this sector and in order to keep pace with the rapid developments in the field of energy and trade, foreseeing the facilitation of the contractual conditions for theregulation and implementationofthe contractquicklyaremeantbytheexperts of thissector so thatinvestment problemcan b overcome and foreign and domestic investorscanbe encouraged.In the lastthreedecadesin Iran,contracts have been foreseenfo this purposeonthebasisof permits for economic, social and cultural development programs as well as resolutions of theCabinet of Ministers which in the upstream sector of the oil industry arecalled IPC(IranianPetroleum contracts). Therefore,in this research, an attempt has been made to use the descriptive-analytical research method, while examining the rules and regulations governing the acquisition of lands required by these projects in the oil and gas industry and at the same time, the acquisition of lands required by contractors in upstream projects are dealt with In this study, a question is raised:How was the acquisition of land in the oil and gas industry, especially in the important IPCcontract, and what are the legal principles and provisionsof the contract based on? the present research has shown with objective, practical research and externalfacts in the land acquisition sector that this section is related to the obvious and primary necessity of the implementation of this type of contracts, and due to the long duration of the mentioned contracts and the heavy financial implications, it is of great importance from the point of view of public rights.
