A Study of Jurisprudential Viewpoints about the Religious Preference of Prohibiting a Wife from Leaving Home by Her Husband

Abstract :

One of the famous jurisprudential views on women's departure from home is the religious preferance of prohibiting a wife from leaving home by her husband. With the purpose of delving deep into the above theory, the present research deals with the reasons by which some well-known jurists demand the preference of ordering women to stay at home and the favorability of putting them in detention. The research method is descriptive-analytic and the results showed that drawing inferences about the obligation of staying at home from the cited verses and Rawāyāt is difficult and that the acceptance of this view, especially in the current era, would lead to cases of corruption such as Osr and Haraj (hardship) for women, allocation of majority, and contradiction with the Qur'anic command of "consorting with them in an honorable manner". Due to rational corruption and contradiction with the Qur'anic commands, some traditions which obligate putting women in detention by their husbands should be interpreted by some other aspects rather than obligation. Therefore, the command of putting women in detention at home and prohibiting them from leaving is a guiding issue and rational advice with respect to social conditions in society.
