Abstract
In legal proceedings, based on the perspective of the contractual nature of the proceedings, the theory of effective cooperation between the litigants and the judge has been proposed; this means that the proceedings, while being considered a process belonging to the judge, also belong to the parties. This sharing of the subject requires a kind of constant cooperation in determining the subject of the lawsuit as well as during the proceedings. Although this cooperation is seen in the civil procedure, but its necessity is twofold in the commercial procedure; because it causes speed in proceedings and quick resolution of disputes. This cooperation can have different aspects that we will examine in this article with a comparative view and library study.
