Abstract :
The effect of the marriage contract as the most important custom-made contract is the transfer of large ownership from the seller to the buyer; the claim of third-party ownership by the third party undermines the work. The rules governing the rights of Iran in the discussion of voyage and warranties of understanding implies that the result of such a claim is the complete abolition of the state of affairs and the return of the status to the former (before the conclusion of the contract) and, accordingly, all the rights of the third party claiming The owner), and the original of the property is available to each of the parties, to be returned to him and to compensate for all damages and interests. During the review of this type of contract in the jurist's books and in the civil code, it is seen that the non-person has been the focus of the discussion, and all efforts are limited to the issues of the author (permission), the permitted (permissible) agreement and the permission (permission) Has been.
