Abstract :

The peaceful use of atomic energy is acknowledged in the fundamental principles of international law. Article 4 of the NPT grants member states the right to research, produce, and utilize atomic energy for peaceful purposes without discrimination, in line with Articles 1 and 2 of the Treaty. This right to peaceful atomic energy must be applied "without discrimination." Article 4 is crucial as it legitimizes uranium enrichment and the production of sensitive nuclear fuel, affirming member countries' rights to enrich uranium, reprocess, and produce nuclear fuel. In this research, the author examines Article 4 of the NPT and discusses the provisions of the JCPOA, which outline the duties, obligations, and limitations of the Islamic Republic of Iran regarding nuclear development. The analysis of Article 4 and the JCPOA reveals notable ambiguities and contradictions in the application of Article 4's provisions concerning Iran, raising concerns about the credibility and socio-political dignity of the Iranian people. This research will adopt an analytical and descriptive approach.
