Abstract :
The marriage contract and family establishing were reconfirmed in Islam and The Muslims wereencouraged in such practices. However some times the divorce becomes a necessity. Otherwisein such cases if either the man or the woman would not claim for divorce, exhausting difficulties,crimes, mental problems and sever worries might occurred which not only make the marital lifedifficult but also may cause catastrophic events in the society. “Talagh” (divorce) rooted from theword “talgh”( separation) which meant either a man or woman would be separated from him/herspouse. Kole divorce occurs when a woman due to her hate of her husband would bestow her bellongings to him to dissolve the marriage bond between. By studying the Quran and the tradition wecould end to the conclusion that there is no any discrimination between man and woman regardingthe divorce verdict. The woman could claim for divorce due to her aversion toward her husband.
